Article 1 — Purpose

These terms of use (hereinafter the "Terms of Use") govern access to and use of the website vortex-corner.com (hereinafter "the Site") by any person who visits it (hereinafter "the User").

Purchases are governed by the Terms of Sale. Information about the publisher is set out in the Legal Notice.

The Site is published by SAS VORTEX, a simplified joint-stock company with share capital of €2, registered with the Paris Trade and Companies Register (RCS Paris) under number 991 283 136, whose registered office is at 200 rue de la Croix-Nivert, 75015 Paris. It is represented by Gaël Pentecouteau, President. Contact: contact@vortex-corner.com.

Article 2 — Description of the Site

Vortex Corner is an online alternative art gallery. It presents and sells works by artists from the worlds of comics, tattooing, music and illustration: Fine Art prints, including numbered and signed editions, art prints, textiles and collectibles.

The Site includes in particular:

  • the gallery and shop: artist pages, universes, product pages, basket;
  • Club Vortex: newsletter, welcome code and early access to drops;
  • the customer account: order tracking, addresses, Club access;
  • favourites;
  • forms: contact, custom quote request, artist application, back-in-stock alert;
  • customer reviews;
  • the Journal, with its news, events and signing sessions;
  • Vortex Solutions: a service for designing and producing art editions for professionals (festivals, labels, publishers, venues).

Article 3 — Acceptance and amendment of the Terms of Use

Use of the Site implies acceptance of these Terms of Use. Vortex Corner may amend them to reflect changes to the Site or to the regulations. The applicable version is the one online at the time of consultation, and its date appears at the top of the page. In the event of a substantial amendment, account holders will be informed by email or by a message on the Site.

Article 4 — Access to the Site

4.1. The Site is accessible free of charge to anyone with Internet access. Connection and equipment costs remain the responsibility of the User.

4.2. Vortex Corner endeavours to make the Site permanently accessible, without being bound by an obligation of result. Access may be suspended, in particular for maintenance or updates, or in the event of a breakdown or force majeure.

4.3. Drops may be temporarily reserved for Club Vortex members logged in to their account, before being opened to the public.

Article 5 — Customer account

5.1. Creating an account is free and optional. It is not required in order to place an order, but it allows the User to track their orders and, for Club members, to access drops in advance.

5.2. Login is by means of a one-time code sent by email. The User undertakes to provide an accurate email address under their control. The account is personal. The User is responsible for its use and must report any fraudulent use without delay to contact@vortex-corner.com.

5.3. The User may delete their account at any time by simple request to contact@vortex-corner.com. Data required for legal obligations (invoices, guarantees) is retained for the periods prescribed by law.

5.4. Vortex Corner may suspend or delete an account in the event of a serious breach of these Terms of Use (fraud, identity theft, abusive resale of drops, abusive behaviour). The User is informed beforehand, except in an emergency or where required by law.

Article 6 — Favourites

Works added to favourites are stored solely in the User's browser, on the device used. They are not transmitted to Vortex Corner and may be lost if browsing data is cleared or the device is changed.

Article 7 — Club Vortex and communications

7.1. Membership of Club Vortex is free. It entitles the member to a 10% discount code on their first order, to access to drops 24 hours before they open to the public, provided they are logged in to their account, and to advance information (exhibitions, signing sessions, pre-orders, collaborations).

7.2. By signing up, the User agrees to receive the Club newsletter. They may unsubscribe at any time using the link in each email. Unsubscribing ends any future Club benefits.

Article 8 — Forms and content submitted by Users

8.1. Forms. Information submitted through the contact, quote or availability alert forms is used solely to respond to the request concerned.

8.2. Artist applications. An artist submitting their work warrants that they are its author or hold the necessary rights. They retain all their rights in their works. Vortex Corner undertakes to use the material received solely to assess the application, not to publish or exploit it without a separate written agreement, and to delete it on request. Submitting an application creates no obligation to collaborate.

8.3. Customer reviews and photos. A customer may submit a review together with a photograph of the work in their home. In doing so, they warrant that they are the author of the photograph and, if it shows people, that they have their consent. They authorise Vortex Corner, free of charge and on a non-exclusive basis, to reproduce and publish this review and photograph on the Site, its social networks and its newsletter. This authorisation is valid worldwide and for the full term of protection of the rights. The customer may withdraw it at any time, for the future, by email: their content is then removed from the Site within a reasonable time.

8.4. Prohibited content. It is prohibited to submit content that is unlawful, abusive, defamatory, discriminatory, infringing or that invades the privacy of others, as well as unsolicited advertising content.

Article 9 — Customer reviews: how they work

In accordance with Article L. 111-7-2 of the French Consumer Code (Code de la consommation):

  • Verification. Published reviews come from customers who have purchased the product concerned. Vortex Corner verifies that the order exists before publication.
  • Moderation. Reviews are read before being published. A review may be rejected if it contains unlawful or off-topic material, personal data or abusive language, or if it does not relate to the customer's experience. A review is never rejected on the grounds that it is negative. The author of a rejected review is informed and given the reason for the rejection.
  • Consideration. Submitting a review with a photo may entitle the customer to a 10% discount on their next order. This benefit is granted regardless of the rating given.
  • Ranking and duration. Reviews are displayed in random order, without distinction according to rating. They remain online indefinitely, unless their author requests their removal, which then takes place as soon as possible.
  • Response. Vortex Corner may respond publicly to a review. A customer may report a review they consider inaccurate to contact@vortex-corner.com.

Article 10 — Intellectual property

10.1. The works. The works reproduced on the Site belong to their respective authors, who retain all rights in them. They are presented with their permission.

10.2. The Site. The Vortex Corner trade mark and logo, the texts, the visual identity, the photographs and the interface of the Site are protected by intellectual property law. They belong to Vortex Corner or are used with permission.

10.3. Prohibited uses. Except with prior written permission, and subject to the statutory exceptions such as strictly private copying, it is prohibited to:

  • reproduce, distribute, modify or exploit all or part of the Site or of the works, by any means whatsoever: downloading, screenshots, printing, reuse on another medium, printing on products;
  • extract the content of the Site by automated means (harvesting, scraping, bots);
  • use the works and content of the Site to train, feed or test artificial intelligence systems. Vortex Corner and the artists expressly opt out of text and data mining within the meaning of Article L. 122-5-3 of the French Intellectual Property Code (Code de la propriété intellectuelle).

Any unauthorised exploitation constitutes infringement (Articles L. 335-2 et seq. of the French Intellectual Property Code).

10.4. Sharing. Sharing a page of the Site on social networks, by means of a link or using those networks' native sharing tools, is permitted and indeed welcome, provided that the work remains associated with the name of its artist and with Vortex Corner.

Article 11 — Prohibited conduct

The User undertakes not to:

  • interfere with the operation or security of the Site: intrusion, overloading, circumvention of technical measures, in particular those governing early access to drops;
  • use automated purchasing bots or scripts;
  • create multiple accounts or use false identities to obtain more than once a benefit reserved for a first order or to exceed a purchase limit;
  • impersonate a third party;
  • use the Site for unlawful purposes.

Vortex Corner may cancel an order placed in breach of this article and refund the customer, or suspend the account concerned.

Article 12 — Personal data and cookies

12.1. Vortex Corner processes Users' personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the French "Informatique et Libertés" Act. Data is never sold. The Privacy Policy sets out the data collected, the purposes, the legal bases, the retention periods and the recipients, including technical service providers such as Shopify.

12.2. The User has the right of access, rectification, erasure, restriction, portability and objection. They may also set instructions regarding what happens to their data after their death. These rights may be exercised at contact@vortex-corner.com. The User may also refer the matter to the CNIL (www.cnil.fr).

12.3. Cookies. Cookies strictly necessary for the operation of the Site (basket, session, security) are placed without consent. Other cookies (audience measurement, personalisation) are placed only after the User's consent, obtained via the banner displayed on the first visit. The User can refuse as easily as accept and can change their choices at any time via the "Cookie preferences" link.

Article 13 — Liability

13.1. Vortex Corner makes every effort to provide accurate and up-to-date information, but cannot guarantee the absence of errors or omissions. Information about artists, events and drop dates is given for guidance only and may change.

13.2. Vortex Corner is not liable for damage resulting from an interruption of the Site, from a virus that could not be detected despite the precautions taken, from use of the Site that does not comply with these Terms of Use, or from the content of third-party sites to which links refer (social networks, artists' websites, partners).

13.3. This clause in no way limits Vortex Corner's liability towards its customers for the performance of orders, which is governed by the Terms of Sale and the mandatory provisions of the French Consumer Code.

Article 14 — Reporting unlawful content

Any unlawful content on the Site, in particular in customer reviews, may be reported to contact@vortex-corner.com. The report must specify the nature of the content, the address of the page, the reasons for the report and the identity of the person making it. Vortex Corner handles reports diligently and informs the author of the content if it is removed.

Article 15 — Governing law and disputes

These Terms of Use are governed by French law. In the event of any difficulty, the User is invited to contact Vortex Corner to seek an amicable solution. Failing that:

  • a consumer User may refer the matter to the court of their choice among those designated by law, including the court for their place of residence;
  • between businesses, the courts of Paris have exclusive jurisdiction.
